  • Game-over for Partial Birth Abortions

    JusticeKennedy In a surprising (and rare these days) victory for conservatives and President Bush, the Supreme Court Wednesday upheld the 2003 federal law prohibiting partial birth abortions.  The ruling prohibits the extraction of a fetus after 20 weeks of pregnancy and crushing its skull before it is delivered.

    Justices Thomas, Scalia, Alito, Roberts, and Kennedy voted in favor of upholding the ban in a 5-4 ruling.  Kennedy, who has long expressed his distate for partial birth abortions, wrote the majority opinion.  Republican presidential hopefuls joined President Bush in expressing support for the ruling, while Democrats decried it.

    The ruling could open the door for states to pass more restrictive laws concerning abortions in effort to test how far the bench is drifting away from its previously activist nature.
