It's now official. You own nothing. Anything you have, the government
can take from you at its whim, provided it claims it is serving the
"public good". I suppose congratulations are due to the left. You've
won. The dream of Karl Marx is here -- there is no longer any private
property in the United States. (Of course, the beneficiaries of this
collectivization of all land will be a powerful eite, but, hey, that's
they way it
always works in practice, right? America is just a bit more honest about which people are more equal than others.)
Supreme Court Approves Unlimited Seizure Power
One must love the logic that "local authorities" know better than
Federal judges as to what is the best use of propery. Yo,
Justice-dudes! Got a radical notion for you. How's about this -- the
people who
own the property know the best use for it?
The idea that an individual only owns their business, land, or home
provided no one can devise a "better use" for it is anathema to the
basic moral and legal principles of America. (As is, I suppose,
invading a country which wasn't attacking us or an ally...) I suppose
it's a good thing America has a 'conservative' president. Imagine how
much change there'd be under a 'radical' one!
Overall, this has been a wretched year for the Supreme Court.
Increasing federal power over the issue of medical marijuana, waffling
and ignoring the gitmo situation, and now this. The sad thing it, with
Dubya having a shot at three nominations, it is only going to get
worse. (Though, to their credit, it was the hard right of the court
which dissented here; the moderates carried the day, placing the State
above the individual.)
Problem is, every other nation is even
worse
when it comes to the issues I care most about. America remains the
pinnacle of an island which long ago sank into the sea. At what point
will it matter if the surface is a mile overhead or two miles?

This lost lamented mythical nation you mourn has as much basis in reality as Atlantis ever did.
Read the Constitution's fifth amendment so-called Takings clause.
Libertarian Presidential candidate Gene Burns is happy with Justice Sandra Day O'Connor's position. Just because some count on our unfamiliarity with the Constitution and seize on this un-newsworthy non-break with legal precedent of long-standing, absorbed into the Bill of rights over 200 years ago, to bash on Evil Leftist Liberals who're gwine come take yer house and yer gun, doesn't mean they know what they're talking about.
Hm.. I had to re-read that above comment like three of four times. Too many catch phrases, not enough substance. .. That and a hell of a run-on sentence filled with name-calling.
Anyway I hear what you're saying on the judicial system. We've yet to stumble on the perfect balance of powers. The checks and balances fall slightly short on the judicial branch.
